Welcome to Getzyl. These Terms and Conditions ("Terms") govern your access to and use of the Getzyl mobile application, website, and related services (collectively, the "Services").

1. About Getzyl 

Getzyl is an online food ordering and delivery platform that enables users to browse menus, place orders, and receive food and beverages from participating restaurants and cafés.

Getzyl acts as a technology platform connecting customers with restaurant partners and delivery services.

2. Eligibility

To use Getzyl, you must:

• Be at least 18 years old, or the legal age required in your jurisdiction.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate and complete registration information.

You are responsible for maintaining the confidentiality of your account credentials.

3. Account Registration

When creating an account, you agree to:

• Provide accurate and up-to-date information.
• Keep your account details secure.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activities conducted through your account.

4. Ordering Food

By placing an order through Getzyl, you agree that:

• All orders are subject to restaurant acceptance and availability.
• Menu items, prices, offers, and availability may change without notice.
• Restaurants are solely responsible for food preparation, quality, ingredients, and packaging.
• Delivery times are estimates and may vary due to weather, traffic, restaurant workload, or other circumstances beyond our control.

5. Pricing and Payments

• Prices displayed in the app are determined by restaurant partners.
• Additional fees such as delivery charges, service fees, taxes, or government charges may apply.
• Payment must be completed before an order is processed unless a cash-on-delivery option is available.
• Getzyl reserves the right to correct pricing errors or cancel orders affected by technical mistakes.

6. Cancellations and Refunds

Order Cancellation

Orders may only be cancelled before the restaurant begins preparing the food.

Once preparation has started, cancellation requests may be declined.

Refunds

Refund eligibility may include:

• Failed transactions
• Missing items
• Incorrect orders
• Orders not delivered

Refund approval is subject to review and verification.

Approved refunds will be processed through the original payment method where applicable.

Processing times may vary depending on payment providers and banks.

7. User Responsibilities

You agree not to:

• Use the app for unlawful activities.
• Provide false or misleading information.
• Attempt to interfere with the operation of the platform.
• Use automated tools, bots, or scripts to access the Services.
• Abuse restaurant staff, delivery personnel, customer support representatives, or other users.
• Engage in fraudulent transactions or payment disputes without valid reason.

Violation of these Terms may result in account suspension or termination.

8. Restaurant Partner Responsibility

Restaurant partners are solely responsible for:

• Food quality and safety
• Ingredients and allergen information
• Food preparation and packaging
• Compliance with applicable food safety laws and regulations

Customers with allergies or dietary restrictions should contact the restaurant directly before placing an order.

9. Delivery Services

Delivery times provided by Getzyl are estimates only.

Delays may occur due to:

• Traffic conditions
• Weather conditions
• Restaurant preparation delays
• High order volumes
• Events beyond reasonable control

Getzyl is not liable for delays resulting from such circumstances.

10. Promotions and Discounts

Promotional offers, discounts, referral rewards, and coupon codes:

• May be subject to separate terms.
• May be modified or withdrawn at any time.
• Cannot be exchanged for cash unless required by law.
• May be limited to specific users, restaurants, or locations.

Getzyl reserves the right to cancel promotions in cases of misuse or fraud.

11. Intellectual Property

All content available through Getzyl, including but not limited to:

• Logos
• Branding
• Software
• Graphics
• Text
• App design
• Features and functionality

is owned by or licensed to Getzyl and protected by applicable intellectual property laws.

You may not copy, distribute, modify, reverse engineer, or exploit any part of the Services without prior written permission.

12. Limitation of Liability

To the maximum extent permitted by law, Getzyl shall not be liable for:

• Indirect or consequential damages
• Loss of profits or revenue
• Service interruptions
• Delayed deliveries
• Food quality issues caused by restaurants
• Technical failures outside our reasonable control

Our total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Getzyl, its affiliates, employees, partners, and service providers from any claims, losses, damages, liabilities, and expenses arising from:

• Your misuse of the Services
• Violation of these Terms
• Violation of applicable laws
• Infringement of third-party rights

14. Suspension and Termination

We may suspend or terminate access to the Services without prior notice if:

• You violate these Terms.
• Fraudulent or suspicious activity is detected.
• Required by law or regulatory authorities.
• Continued access may harm Getzyl, its users, or partners.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
